Terms of Service

1. Who we are

followup (“followup”, “the service”, “we”, “us”) is operated by LightningAI. The service sends scheduled WhatsApp reminders to your past customers on your behalf. These Terms of Service (“Terms”) form a binding agreement between you and us.

2. Accounts and eligibility

You must be at least 18 years old and authorized to act on behalf of the business you register. You are responsible for the activity that happens under your account and for keeping your login credentials secure. Let us know promptly at support@garageplus.co.il if you suspect unauthorized use.

3. Acceptable use

You agree that you will not:

• Upload contact lists you do not have a lawful basis or consent to message.
• Use the service to send spam, marketing blasts, or any content that violates WhatsApp’s Business Messaging Policy.
• Send unlawful, deceptive, harassing, or harmful messages, or messages to recipients who have opted out.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the service or its infrastructure.

You are solely responsible for the content of the reminder messages you configure and for complying with all laws that apply to contacting your customers, including consent and anti-spam rules.

4. WhatsApp and third-party services

Messages are delivered through the WhatsApp Business Platform, which is provided by Meta and subject to its own terms and policies. We are not responsible for outages, delivery delays, or policy changes on platforms we do not control. When a recipient replies STOP, we register an opt-out immediately and will not message them again.

5. Fees

Paid plans consist of a fixed subscription fee plus a per-message rate that mirrors WhatsApp Business pricing in your region. Fees are billed in advance and are non-refundable except where required by law. We will give you reasonable notice before changing prices.

6. Your data

You retain ownership of the customer data you upload. We process it only to provide the service, as described in our Privacy Policy. You can export your data to CSV at any time and delete your business with a single confirmation.

7. Availability and changes

We work to keep the service available and dependable, but we provide it “as is” without warranties of uninterrupted or error-free operation. We may update, suspend, or discontinue features, and we may revise these Terms from time to time. Material changes will be announced in-app or by email; continued use after a change means you accept the revised Terms.

8. Limitation of liability

To the maximum extent permitted by law, LightningAI will not be liable for indirect, incidental, or consequential damages, or for lost profits, revenue, or data, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

9. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that creates risk or legal exposure for us or other users.

10. Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. The competent courts of Tel Aviv-Jaffa will have exclusive jurisdiction over any dispute, unless mandatory law in your location provides otherwise.
